1. Legal information and agreement
The Asociación de Empresarios Hoteleros de la Costa del Sol (AEHCOS) is entered in the Registration of Professional Associations of the Mediation Centre, Arbitration and Conciliation of the Provincial Delegation of Malaga of the Department of Labour and Industry of the Government of Andalusia, dated 27 July 1977, deposit number 29/39 and VAT number G-29073954.
The current rules regulate the use of the service of the Internet portal (henceforth, the “Portal”) that the ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) (henceforth, ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) provides for Internet users.

Usage of the Portal is attributed to the condition of the user of the Portal (henceforth, the ‘User’) and implies agreement to all of the conditions included in this Legal Notice. Using the service of the Portal has a limited duration from the moment the User is connected to the Portal or to one of the services through which it is facilitated. Therefore, the User must read this Legal Notice carefully every time they intend to use the Portal, since the Portal and its conditions of use contained in this Legal Notice may change.
Some of the Portal’s services accessible to Internet users or exclusive for customers of the ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) can be subject to certain conditions, regulations and instructions that, when applicable, substitute, complete and/or modify this Legal Notice and must be accepted by the User before beginning to use the corresponding service.
2. Industrial and intellectual property
All of the contents of the Portal, understood by those titled by but not limited to, the texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or audio contents, as well as their graphic design and code sources (henceforth, the ‘Contents’), are the intellectual property of the ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) or of third parties, and it may not be construed that the User can relinquish any of the usage rights recognised by the governing law in regards to intellectual property, except for those that are strictly necessary for the use of the Portal.
The brands, business names or distinguishing signs are owned by ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) or third parties, and it cannot be construed that access to the Portal does not attribute any rights to aforementioned brands, business names and/or distinguishing signs.
3. Conditions of Use of the Portal
3.1 General
The User agrees to the proper usage of the Portal in conformance with the Law and this Legal Notice. The User will respond to ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) or third parties for any damages or injuries that could cause non-compliance with aforementioned obligation as a consequence.

In accordance with current legislation, the User must refrain from, but is not limited to, the following:
Reproducing, copying, distributing, providing, publicly communicating, transformign, or modifying the Contents except in authorised cases by the law or expressly permitted by ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) or by anyone who is entitled to the usage rights when applicable.
Reproducing or copying the Contents, which can be considered as Software or Databases, for private use in conformance with current legislature in terms of intellectual property, as well as public communication or providing it to third parties when these acts necessarily imply reproduction by the User or a third party.
Extracting or reusing the entire or a substantial part of integral Contents of the Portal as well as the databases that ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) provides to the Users.
3.3 Data collection forms
Without prejudice to what is stated in clause 5 in this Legal Notice, as well as privacy policies accessible from the Portal and which can be applicable at any time, the use of certain services or requests directed towards ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) are dependent on prior compliance to the corresponding User’s registration.
All of the information provided by the User through Portal forms in the aforementioned purposes or any others should be truthful. 3.4 Introduction to Portal links
The Internet user who wants to add links from their own web pages to the Portal must comply with the conditions that are detailed below, an ignorance of which does not constitute a release from the liabilities deriving from Law:
The link will only link to a Portal home or main page but cannot reproduce it in any way (online links, copying text, graphics, etc.).
In any event, it is prohibited, in compliance with the applicable and current legislation at any time, to establish frames of any type that surround the Portal or allow the visualisation of Contents through Internet addresses that are different than those of the Portal, and in any case, when they are seen jointly with contents unaffiliated with the Portal in such a way that: (I) produces, or is able to produce, an error, confusion, or trick the users on the true origin of the service or Contents; (II) supposes an act of comparison or unfair imitation; (III) exploits the reputation of the brand and prestige of ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS); or (IV) or is prohibited by current legislation in any other way.
The page containing the link may not incur any type of false, inaccurate or incorrect statement about ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS), their partners, employees, customers or the quality of services they offer.

4. Exclusion of liability
4.1 On the Information
Access to the Portal does not imply obligation by ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) to confirm the truthfulness, accuracy, adaptation, suitability, exhaustiveness and currency of the information supplied through it. The contents of this page are of a general nature and do not constitute, under any circumstances, the provision of any kind of legal advisory service, which is why this information is insufficient for personal and business decision making on behalf of the User.
ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) is not responsible for decisions made from the information provided in the Portal nor for any damages or losses to the User or third parties incurred in the proceedings that have information obtained from the Portal as their only basis.
4.2 On the quality of the service
Access to the Portal does not imply obligation by ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) to control the absence of viruses, worms or any other harmful computer element. It is, in any case, the duty as a User to have the right tools to prevent and disinfect the system of harmful computer programs.
ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) is not responsible for damages produced in the User’s or third parties computer equipment during the usage of the Portal’s service.
4.3 On the availability of the Service
Access to the Portal requires services and supplies from third parties, including transportation through telecommunication networks whose reliability, quality, continuity and functioning do not correspond to ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS). Therefore, the services provided through the Portal can be suspended, cancelled or become inaccessible, either prior to or simultaneous to the Portal’s service rendering.
ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) is not responsible for damages or losses of any kind caused to the User that bring about failures or disconnections in the networks of telecommunications that produce the suspension, cancellation or interruption of service in the Portal during its use or prior to this.
4.4 On content and services linked through the Portal
The service of access to the Portal includes technical linkage devices, directories and even search tools that allow the User to access other pages and portals on the Internet (henceforth, ‘Linked Sites’). In these cases, ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) acts as a service provider in accordance with Article 17 of Law 34/2002 of 12 July, Services for Information Society and Electronic Commerce (LSSI) and will only be responsible for the content and services provided in the Linked Sites as long as they are effectively aware of any illegality and have not deactivated the link with all due diligence. In the event that the User considers a Linked Site to have illegal or inappropriate content, they can communicate this to ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) in accordance with the procedure and effects established in clause 6, although in no case does such notification impose any obligation to remove the link in question.
Under no circumstances should the existence of Linked Sites presuppose the existence of agreements with the owners or people in charge of them, or the recommendation, promotion or identification of ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) with the manifestations, contents or services provided.
ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) does not know of the content and services of the Linked Sites and therefore is not responsible for damages caused by illegality, quality, outdatedness, unavailability, error or uselessness of the content and/or services from the Linked Sites or for any other damage that is not directly imputable to ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS).
5. Protection of personal information
Information collected through data collection forms on the Portal will be incorporated into an automated personal information file for which ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) is responsible. This entity will treat the information confidentially and collect these in files registered with the Spanish Agency for the Protection of Data for this purpose. Also, ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) will cancel, erase and/or block information when it is inexact, incomplete or it has stopped being necessary or pertinent for its purpose, in conformance with the provisions of the legislation on data protection.
By clicking the ‘send’ button on the corresponding form, the User consents to ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) sending the information by email or any other method. The User may withdraw their consent and exercise rights of access, correction, cancellation and opposition at the address noted in clause 1.
ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) adopts the security levels required by the Regulations for Means of Security passed by the Royal Decree 720/2007 of 21 December, approving the Development Regulation of the Organic Law 15/1999 of 13 December of the Personal Data Protection Act. Notwithstanding the foregoing, technical security in a medium like the Internet is not impregnable and there still may be filtrations caused by premeditated actions on behalf of third parties.

Cookies are automatic processes for collecting information on preferences determined by a user during his/her visit to a specific web page. This information is recorded in small files that are imperceptibly stored in the computer equipment of the corresponding user. The Portal is accessible without needing the cookie options to be enabled, although this can prevent the proper functioning of security mechanisms for exclusive services or certain services that require greater security. The main purpose of the cookie files in the Portal is to make navigation easier for the User.
The server that transmits and activates the automatic collection procedures is valid for 12 months, after which the cookie files are automatically erased.
6. Notice of unlawful or inappropriate activities
In the event that the User or any other Internet user becomes aware that the Linked Sites are linked to pages whose content and services are illegal, harmful, violent or contrary to good morals, they can contact ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) by indicating the following:
Personal information of the informant: name, address, phone number and email address;
Description of the facts that reveal the illicit or inappropriate character of the Linked Site;
In the event of an infringement of rights, such as intellectual and industrial property rights, the personal details of the owner of the right infringed when it is someone other than the informant. Proof of the entitlement of the owner of the rights must also be provided, when applicable, proof of representation to act on behalf of the owner when it is someone other than the informant;
An express statement that the information contained in the complaint is exact.
Receipt by ASOCIACION DE EMPRESARIOS HOTELEROS DE LA COSTA DEL SOL (AEHCOS) of the aforementioned notification in this clause does not suppose, according to what is stated in the LSSI, knowledge about the activities and/or content mentioned by the notifier.
Proof of the entitlement of the owner of the rights must also be provided, when applicable, proof of representation to act on behalf of the owner when it is someone other than the informant; An express statement that the information contained in the complaint is exact.
